The Law

WASHINGTON DC Amendment Act B18-622 “Legalization of Marijuana for Medical Treatment Amendment Act of 2010” – Approved 13-0 by the Council of the District of Columbia on May 4, 2010; was signed by the Mayor on May 21, 2010. After it was signed by the Mayor the law underwent a 30-day Congressional review period. Neither the Senate nor the House acted to stop the law, so it became effective when the review period ended immediately.

The legal Medical Marijuana Program in Washington DC allows legal medical marijuana patients to receive a marijuana recommendation from a certified physician, and apply for a State-issued District of Columbia Medical Marijuana ID Card.

The District of Columbia Marijuana Registry IS MANDATORY, and does NOT accept any other state’s registry cards for purchase at in-state dispensaries. Washington DC has received over thousands of recommendations and is continually growing. In order to become a legal medical marijuana patient you must have a qualifying condition as outlined by the department of health services and/or department of justice.

Qualifying

The process for getting Medical Marijuana can be done via the following two steps: (1) Obtain a recommendation from a registered physician recommending you for medical marijuana, (2) Submitting your application to the Department of health for your medical marijuana card.

  • You must be a resident of the District of Columbia
  • You must be able to show two proofs of residency within the district
  • You must be diagnosed with a qualifying medical condition or be currently undergoing a qualifying medical treatment

Maryland Medical Marijuana Overview -

The Law

On April 08, 2014, House Bill 881 was approved by the House 125-11 and by the Senate 44-2. Governor Martin O’Malley signed the bill on April 14, 2014, effective June 01, 2014 and active in 2014. The House Bill 881 tasked the Maryland Department of Health and the Natalie M. LaPrade Medical Marijuana Commission with developing regulations for a patient registry and identification cards, dispensary licensing, regulating processors, settling fees, and creating possession limits. The Commission includes provisions to issue yearly requests for applications from academic medical centers, to operate medical marijuana compassionate use programs in action. The legislation that passed effectively removed all state-level penalties on the use, possession, and cultivation of marijuana by patients issued with a written or oral recommendation by their primary care physician stating that he or she "would benefit from medical marijuana." The Maryland Patient Registry fee has not yet been assigned and it is to be determined by the Medical Cannabis Commission. The Maryland Marijuana Registry is mandatory, and does NOT accept other state’s registry cards at this time.

The Program

The State of Maryland has fully legalized their medical marijuana program, which allows patients to receive a medical marijuana recommendation from a certified physician, and apply for a state-issued Maryland Medical Marijuana Card, permitting the patient to purchase marijuana for medicinal use, as per Maryland state guidelines. 

To become a legal medical marijuana patient in Maryland you must meet with a licensed Maryalnd doctor registered with the Maryland Cannabis Commission and be approved for medical marijuana.

Maryland medical marijuana patients are legally allowed to possess a “30-day supply” of medical marijuana. This amount is still to be determined by the Commission. Patients can buy medical marijuana from a licensed dispensary once they are open. The state will issue 94 medical marijuana dispensary licenses throughout the state (two per senatorial district). Maryland will also award and issue 15 cultivator licenses.

Qualifying

Becoming a patient in Maryland is a simple two-step process:

  • Out-of-state residents can come to Maryland and buy medical marijuana. To do this, they must see and be approved by a medical marijuana physician. There is no residency requirement to be eligible for the Maryland Medical marijuana program, you may apply as long as you have a valid US issued photo ID. Any legal Maryland resident can apply and participate in the program and also any person from out-of-state who is in Maryland for the purpose of receiving medical care can be issued a written certification and obtain medical cannabis.
  • Patients must obtain a written certification from a licensed doctor that has recommend medical marijuana in the State of Maryland. You need to first meet with our doctor at their office to establish a bona-fide relationship then you can follow up with a telemedicine consultation.
  • For a patient to become approved into the state’s medical marijuana program, the patient must register with the state of Maryland through the patient portal once it opens up.
  • You do not have to have your MMCC ID# before you meet with the doctor. If you get it after you meet with the doctor then simply provide the ID back to the doctor and they will upload your information into the portal and you are then verified byt the state!

The Law

Ballot Proposition was approved by voters on November 05, 1996. This removed state-level criminal penalties on the use, possession and cultivation of marijuana by patients possessing either a “written or oral recommendation” from their physician, advising that he or she may benefit from the medical use of marijuana.

The State of California has a legalized medical marijuana program, which allows patients to receive a valid medical marijuana recommendation from a certified physician. California residents must be approved for medical marijuana from a licensed physician, and once obtained patients can purchase medical marijuana.

Senate Bill 420 allows patients to possess larger amounts of marijuana when recommended by a physician.
